These Terms and Conditions are intended to keep the Students and their Guardian (hereinafter referred to as “The User”) safe and make Besingular (hereinafter referred to as “The Service Provider”) Online programs exciting, engaging, and productive. By purchasing, using, or allowing the user to use any of Service Providers Online programs, the User hereby agree that they shall abide and be bound by the Service Providers General Terms and Conditions and the Privacy Policy and the same can be found at the T&C and PP. In cases of any indifference of opinion or conflict, by and between the Service Provider and the User, the terms and conditions shall apply and stand good.

The Service Provider shall in no way be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content. The Service Provider  does not endorse or control the User Content transmitted or posted on the Site by the user and therefore, accuracy, integrity or quality of User Content is not guaranteed by The Service Provider. You understand that by using the Site, you may be exposed to User Content that is offensive, indecent, or objectionable to you. Under no circumstances will The Service Provider be liable in any way for any User Content, including without limitation, for any errors or omissions in any User Content, or for any loss or damage of any kind incurred by you as a result of the use of any User Content transmitted, uploaded, posted, e-mailed or otherwise made available via the Site. You hereby waive all rights to any claims against The Service Provider for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with User Content.

You hereby acknowledge that The Service Provider has the right (but not the obligation) in its sole discretion to refuse to post or remove any User Content and further reserves the right to change, condense, or delete any User Content. Without limiting the generality of the foregoing or any other provision of these Terms and Conditions, The Service Provider has the right to remove any User Content that violates these Terms and Conditions or is otherwise objectionable and further reserves the right to refuse service and/or terminate accounts without prior notice for any users who violate these Terms and Conditions or infringe the rights of others.

The Service Provider attempts to be as accurate as possible in the description of the product on the Site. The Site may contain typographical errors or inaccuracies and may not be complete or current, and The Service Provider reserves the right to correct, change or update information, errors, inaccuracies, or omissions at any time without prior notice. Please note that such errors, inaccuracies, or omissions may also relate to pricing and availability.

I. Code of Conduct

The user hereby agrees that it has read, understand, and agree to abide by the Code of Conduct set forth below. The user also agree that it had reviewed the Code of Conduct and must act in a way that is in keeping with the Code of Conduct and are subject to all local, state, and federal laws governing the Internet. The Users subscription can be canceled and shall be subject to disciplinary actions if the deeds or attitudes seem to be harmful to the atmosphere, to other user, the faculties or such other persons. However, in such an event when there is a claim that a user has violated this conduct/ policy, he/she will be notified of the suspected violation and given an opportunity to present an explanation. Refunds will not be given for products canceled for failure of the user to abide by the Code of Conduct.

USERS May NEVER:

  1. engage in or threaten violence.
  2. bully, intimidate, or harass other peers during the class.
  3. use this service, or materials provided as part of this service for illegal or immoral activity.
  4. use inappropriate language.
  5. share lesson information with third parties, without permission from instructor.
  6. impersonate another person.
  7. publicly display lesson(s).
  8. sexually harass others.
  9. display pornography or any inappropriate material (including sexual content, inappropriate violence, racism, bullying, etc.) during lessons; or
  10. personally, contact instructors outside of lessons.

USERS MUST:

  1. abide by the rules and regulations of the instructor and The Service Provider.
  2. attend lessons in an appropriate, private setting.
  3. dress appropriately during lessons.
  4. adhere to the terms of use of any sites used, including following the specified age policies; and
  5. only share material that is related to lessons, and appropriate.
  6. not share/copy/quote or use The Service Provider content anywhere without prior permission from The Service Provider.
II. The Service Provider Online Programs
  1. Online Private Lessons (OPL)
    1. General Information
      1. All course plan details are provided to the user while signing up for the course.
      2. The fee for Online Private Lessons is non-refundable and lessons not used by the expiration date are forfeit and cannot be refunded in full or prorated.
      3. Lessons can be rescheduled for any reason up to 24 hours prior to the scheduled lesson by messaging  via the L.M.S account to the Service Provider Operations or emailing at operations@besingular.de with the email subject as re-schedule of the session.
        With at least 24 hour notice, we will gladly reschedule any appointment as per Section II, Point 10 and Point 11, with no penalty.
      4. The lesson progress report can be seen on the L.M.S upon completion of each lesson. The Service Provider is not bound to provide L.M.S service to all the students, the service may not be provided for certain courses taught by the Service Provider.
      5. Lessons are only available for subjects set out by the Service Provider.
      6. Lessons will only be taught in English.
      7. For safety and security reasons, The Service Provider will video record every lesson. Parents and guardians can obtain a copy of the recording by sending an email request to operations@besingular.de. However, if there are multiple students in the lesson from different families and location, please note the Service Provider shall not release the video to protect the privacy of the User.
      8. Generally, only one user per lesson is allowed. However, The Service Provider reserves the right to allow the user to share their lesson link with another user for no additional fee.  All users that participate in the lesson are bound by these Terms and Conditions.
      9. Lessons are a guidance/tutoring service only. The Service provider shall provide the service to the best of its knowledge and ability, but it cannot guarantee any specific learning outcomes. The Service Provider is not responsible for any specific outcome, or lack thereof.
      10. Change in Session Timings and/or Days:
        1. Less than or equal to 15 Hour: The timings and/or days are fixed for the complete duration of the course.
        2. More than 15 Hour or less than equal to 25 Hour: The timings and/or days can be altered only once for the complete duration of the course, if the requested altered timings are available.
        3. More than 25 Hour or less than equal to 50 Hour: The timings and/or days can be altered only twice for the complete duration of the course, if the requested altered timings are available.
        4. More than 50 Hour and less than equal to 100 Hour: The timings and/or days can be altered only four times for the complete duration of the course, if the requested altered timings are available.
        5. More than 100 Hour: The timings and/or days can be altered only five times for the complete duration of the course, if the requested altered timings are available.

      11. User can reschedule* maximum of:
        1. 1 Lesson* for courses of duration of Less than or equal to 15 Hour
        2. 3 Lesson* for courses of duration of in More than 15 Hour or less than equal to 25 Hour
        3. 4 Lesson* for courses of duration in More than 25 Hour or less than equal to 50 Hour
        4. 5 Lesson* for courses of duration in between More than 50 Hour and less than 100 Hour
        5. 10 Lesson* for courses of duration of More than 100 Hour

*: Reschedule will only be based on the last change in session timings and/or days.

  1. The Service Provider is not responsible to provide any reschedule session or recordings for sessions during the session outbreak, due to any difficulty occurring at User’s end including sickness, behavioral dismissals, power failures, weather, and unforeseeable events.
  2. Access to L.M.S and the Service Provider content is only available till a User is enrolled in a The Service Provider Program. The Service Provider will stop the users L.M.S access as soon as the user have completed the course.
  3. The user will get the  Service Provider’s Certificate once it completes and pass all the Service Provider assessments during and after session and, submit the user’s project at the completion of the course enrolled in.

  4. Rescheduling Online Private Lessons
    1. The user is responsible for re-scheduling all lessons via the link sent out, messaging us via the L.M.S account, or via email.
    2. The user  can schedule lesson by messaging us via the L.M.S account to the Service Provider Operations or emailing at operations@besingular.de  With at least 48 hour notice, the Service Provider shall gladly reschedule any appointment as per Section II, Point 10 and Point 11, with no penalty.
    3. If sufficient notice is not provided, then the session is treated as a no show and no reschedule session will be provided.
  5. Group Classes
    1. Classes are on a set calendar (fixed start dates, day of the week, and time) and run for the designated weeks.
    2. Each class will have no more than 4 participants in each class.
    3. The fee for Group Classes in non-refundable and missed classes will be forfeited and cannot be made up or refunded.
    4. Only User registered for the class may participate.
    5. Classes are only available for subjects set out by The Service Provider.
    6. Classes will only be taught in English.
    7. For safety and security reasons, The Service Provider will video record every class. Copies of the recording cannot be provided to protect the privacy of the students in the course. Questions should be addressed to operations@besingular.de
    8. The Service Provider has the right to refuse service.
    9. Lessons are a guidance/tutoring service only. The Service Provider shall provide the service to the best of its knowledge and ability, but it cannot guarantee any specific outcomes. The Service Provider is not responsible for any specific outcome, or lack thereof.
III. Release

As a condition of participation in the Service Provider Online Program, the user have been authorize that photos, videos, images, audio and testimonials may be taken by them and they agree that the said content may be used by the Service Provider in promotional materials, marketing collateral, and online media. These images, testimonials, photos, videos, and audio may be shared and used by corporate partners, the media, or other organizations who work with The Service Provider. The User understand that The Service Provider, its owners, agents, partners, facility providers, and employees will not be held liable for damages and injuries associated with said publishing, including any and all claims based on negligence. The User agree that all images, testimonials, photos, video, and audio taken at or in connection with The Service Provider are the sole and exclusive property of The Service Provider.

IV. Contacting Instructor

The User should be aware that under no circumstances should the user give their personal contact information to staff, nor is staff allowed to give the user their personal contact information. Other than during the lessons, Staff is not permitted to communicate privately with, give out personal contact info to, or become social media friends with the User.

V. Cancellation and Refunds

The User understand and agree that if he/she cancel the registration more than 72 hours prior to the start date of the course for which the user is registered, the user shall receive a refund with a deduction of 10% of the total fee inclusive of taxes.
If the User cannot attend a session for which they are registered and it does not notify The Service Provider more than 72 hours prior to the course session start date, it will be considered a withdrawal/no show and the user shall be responsible for full payment of all fees associated with the user’s registration for that course.

The User agree that refunds will NOT be issued for withdrawals/no shows or cancellations made less than 72 hour prior to the start date of the session cancelled or changed, and improperly made cancellations. The user also understand and agree that refunds will NOT be issued for early withdrawal or dismissal due to absences (for any reason) including sickness, behavioral dismissals, power failures, weather, and unforeseeable events not within the control of The Service Provider or other acts of nature.

If the User leaves a program early for any reason, the tuition is not prorated and no refund will be issued, including partial refunds.

VI. Representations and Warranties

This Site is provided to you “AS IS”. The Service Provider hereby make no representations regarding the use of or the result of the use/depiction of the Contents on the Site in terms of their correctness, accuracy, reliability, or otherwise. The Service Provider shall not be liable for any loss suffered in any manner by the user as a result of depending directly or indirectly on the depiction of the Content on this Site.

The User acknowledge that this Site is provided only on the basis set out in the Terms of Use. The User’s uninterrupted access or use of this Site on this basis may be prevented by certain factors outside our reasonable control including, without limitation, the unavailability, inoperability or interruption of the internet or other telecommunications services or as a result of any maintenance or other service work carried out on this Site.

The Service Provider shall have the right, at any time, to change or discontinue any aspect or feature of the Site, including, but not limited to, content, hours of availability, and equipment needed for access or use. Further, the Site may discontinue disseminating any portion of information or category of information. The Service Provider does not accept any responsibility and will not be liable for any loss or damage whatsoever arising out of or in connection with any ability/inability to access or to use the Site.

For any general information posted on the Site, users must not infer or assume that such information necessarily applies to them.
